MEMBERSHIP TERMS AND CONDITIONS

Effective 1st September 2024.

Please read these terms carefully and check you are happy with them before agreeing to sign up for the membership.

These terms will also be available on our website: www.senseabilitytherapy.co.uk

Applicability: These Membership Terms of Use (these “Membership Terms”) provide the general terms and conditions that govern your monthly membership with Sense Ability Therapy CIC for the learning website located at www.learning.senseabilitytherapy.co.uk (the “Website”) and for your other membership benefits as detailed below.

PRINCIPAL TERMS

  1. This agreement commences once you have indicated your acceptance in the Declaration section of the sign up process.
  2. This agreement will become binding on you (the client) and us (Sense Ability Therapy CIC) when we contact you to confirm your membership application has been accepted, at which point a contract will come into existence between you and us.
  3. You will be entitled to all the rights and privileges set for the Membership chosen.
  4. You cannot transfer this agreement to anyone else.
  5. You must be over 18 years of age and a legal resident of the UK to subscribe to this membership.
  6. Your membership entitles you to the following benefits at Sense Ability Therapy CIC; 10% of all 1:1 clinic sessions, free online access to learning site with continuously updated resources (www.learning.senseabilitytherapy.co.uk)   , up to 3 free last minute cancellations a year, 1 free footscan/Physio review a year (min 6 months membership paid),
  7. Gym memberships are on a monthly rolling contract and can be cancelled at any time.
  8. You agree to the terms and conditions of online appropriate use for the learning website as detailed on the site.

DIRECT DEBIT FEES AND CHARGES

  1. The first month’s membership fees are collected from you by us either by Debit / Credit card at time of purchase, or by Direct Debit on the 1st of the month based on your membership application date. Monthly membership is £10/month from 1st September 2024.
  2. Your second Direct Debit for monthly membership fees only will be collected one month after you joined, Subsequent Direct Debits for monthly membership fees will be collected monthly thereafter. Each payment made is not refundable under any circumstances.
  3. If any Direct Debit is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay us on demand an administration fee of £20. If, despite us having notified you of a missed payment, further payments are missed, we reserve the right to, at our sole election, either suspend or terminate your membership, upon having given you written notice of our intention to do so. We may present an option to reduce the administration fee if the outstanding amount is paid online within 7 days of becoming due.
  4. You agree to advise us immediately of any change to the Members Details provided.

DIRECT DEBIT PRICES

  1. From time to time we may need to increase the price of membership. We will give you at least 1 full months’ notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase. During this period, you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with our notice.

TERMINATION

MONTHLY DIRECT DEBIT MEMBERSHIPS

  1. You may terminate your membership at any point by cancelling your direct debit with your bank, allowing 4 working days for the bank to action this. Please call us for options available to you or for any further information.
  2. In the above circumstances your membership will remain in force until the day before your next payment is due, at which point it will automatically terminate.

MONEY BACK GUARANTEE

  1. As per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you are entitled to cancel your membership and receive a full refund of any fees paid within 14 days of completing your membership application form. However, as per regulation 36 of Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you select to commence your membership immediately, or you ask us to start your membership early, you agree that if you subsequently cancel your membership within the 14 day period, you will be refunded any monies paid, less an amount for the membership you have already used commencing from the first day after joining.

Cancellation and Suspension by Sense Ability Therapy CIC: Sense Ability Therapy CIC reserves the right to cancel or suspend the membership Services at any time and for any reason. Sense Ability Therapy CIC will notify the Member prior to any such cancellation or suspension. In addition, if the Member fails to timely pay any Membership Fees in accordance with these Terms, Sense Ability Therapy CIC may, without limiting any of its other rights or remedies, suspend or cancel the Membership Services. The Membership Services and the billing of any Membership Fees shall be suspended during any period of suspension. Sense Ability Therapy CIC shall not resume Membership Services, including any billing for any Membership Fees, following a suspension without the express approval and consent of the Member.

  • Account Registration and Security: To enjoy full access and use of our Membership Services, you may be asked to provide certain registration details or other information to create a user account (an “Account”).
    • Account Information: It is a condition of your use of the Membership Services that all the information you provide is correct, current, and complete. You may not use someone else’s name, or any name, location, other public profile information or image that violates any third-party rights, is against the law, or that is offensive, obscene, or otherwise objectionable. You agree to promptly notify us if any of your information changes or is inaccurate.
  • Privacy Notice: Please review the https://learning.senseabilitytherapy.co.uk/privacy-policy/  to learn about (A) what information we may collect about you, (B) what we use that information for, and (C) with whom we may share your information.
  • Disclaimer of Warranties: THE MEMBERSHIP SERVICES ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. SENSE ABILITY THERAPY CIC  MAKES NO WARRANTY AS TO THE QUALITY, ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH, OR THE PERFORMANCE OF, THE SERVICES. YOU ARE RESPONSIBLE FOR VERIFYING ANY INFORMATION BEFORE RELYING ON IT. USE OF THE MEMBERSHIP SERVICES IS AT YOUR SOLE RISK. SENSE ABILITY THERAPY CIC DOES NOT WARRANT THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICES AT THE TIMES OR LOCATIONS OF YOUR CHOOSING; THAT THE OPERATION OF THE MEMBERSHIP SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE MEMBERSHIP SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SENSE ABILITY THERAPY CIC  PROVIDES NO WARRANTY OR GUARANTEE OF ANY KIND THAT THE MEMBERSHIP SERVICES WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS. ALTHOUGH EVERY EFFORT WILL BE MADE TO ENSURE OUR BEST SERVICE POSSIBLE.


  • Contracting Entity, Governing Law; Jurisdiction: Subscribers are contracting with SENSE ABILITY THERAPY CIC.

    All matters relating to the Membership Services and/or these Terms, and any dispute or Claim arising therefrom or related thereto (in each case, including non-contractual disputes or Claims), shall be governed by and construed in accordance with the laws of England and Wales.

    You can bring proceedings in respect of these Membership Terms in the English courts.
  • General:
    • Relationship of Parties: You agree that no joint venture, partnership, employment, or agency relationship exists between you and Sense Ability Therapy CIC because of these Terms or your use of the Membership Services.Assignment: You may not assign these Membership Terms without Sense Ability Therapy CIC’s prior written consent, and any unauthorised assignment by you shall be null and void.Equitable Remedies: You hereby agree that Sense Ability Therapy CIC would be irreparably damaged if the terms were not specifically enforced, and therefore you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of these Terms, in addition to such other remedies as we may otherwise have available to us under applicable laws.
    • Force Majeure: Neither you or Sense Ability Therapy CIC will be liable for any failure or delay in performance under these for causes beyond the other party’s reasonable control and not caused by that party’s fault, or negligence, including, but not limited to, “acts of God”, acts of government, flood, fire, civil unrest, acts of terror, strikes or other labour problems, computer attacks or malicious acts, such as attacks on or through the internet, any internet service provider, telecommunications or hosting facility, but in each case, only if and to the extent that the non-performing party is without fault in causing such failure or delay, and the failure or delay could not have been prevented by reasonable precautions and measures and cannot reasonably be circumvented by the non-performing party through the use of commercially reasonable, alternate sources.
