Other examples include racial and ethnic origin, sexual orientation, health data, trade union membership, political opinions, religious or philosophical beliefs.

Processing – means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

We may collect and process the following data about you:

    • information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.
  • Information we receive from other sources. We may receive information about you from other health care professionals. In this case we will have informed you when we collected that data that it may be shared internally and combined with data collected at the clinic.

What is our legal basis for processing your personal data

1. Personal data (article 6 of GDPR)

We process your personal data using your informed consent as part of a client/therapist contract of treatment. The processing of the data is necessary for the performance of our role in providing physiotherapy treatment and to comply with statutory regulations as HCPC registered physiotherapists.

2. Special categories of personal data (article 9 of GDPR)

We obtain your explicit signed consent at the start of the therapy contract. The information is necessary for the safe assessment and treatment of the client using our service. Treatment cannot be given without such information.

Security and Disclosure of your information

The security of your information is important to us and all information is treated as strictly confidential. All staff only have access to the information that is required for them to complete their role and are instructed in confidentiality matters. Paper files are stored securely in locked filing cabinets and the clinic room is secured with only staff members having access. Digital notes are stored securely. Storage of exercise programmes is via Physiotec, who’s server is based outside of the EEA (European Economic Area), By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

The sharing of your information is strictly controlled. We adhere to the Caldicott principles to ensure information is held securely and appropriately.

We may share your information with selected third parties including:

  • Zanda.com for secure storage of clinical records, files, and booking information
  • wibbi.ca for storage and communication of online personalised exercise programmes
  • SumUp.co.uk for processing of payment information
  • Health care providers as part of your care with your consent

We may disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
  • If Sense Ability Therapy CIC or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use [Website terms of use] and other agreements; or to protect the rights, property, or safety of Sense Ability Therapy Ltd, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction or safeguarding issues.

Information is only shared where if there is a clinical, procedural or legal need for it. Anyone involved in the sharing of data is under a legal duty to keep it confidential and secure.

How long do we keep your data

We keep your personal data for no longer than reasonably necessary. We have a statutory requirement to keep records for a period of 8 years following the final treatment session or the death of a client. Following this time all records will be securely destroyed. This time would be longer in the instance of mental health records or children.

Automated Decision making

We do not use any automated decision making in our business.

Further Processing

If we wish to use your personal data for a new purpose, not covered by this Data Privacy notice, then we will provide you with a new notice explaining this prior to commencing the processing.

Your rights

You have the right to confidentiality and for your data to be used in a safe and secure manner. You have the right to know what information we hold about you, what we use it for and who we share it with.

You have the right to access your records, update them and request corrections to any errors. Clinical information may not be changed for legal reasons but you made add a note if you disagree with them.

You have the right to ask us not to process your personal data for marketing purposes. We will inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data.
